General Terms & Conditions – Clara & Violet Vancouver

These General Terms & Conditions apply to all offers, orders, and agreements between Clara & Violet Vancouver (“Entrepreneur”, “we”, “us”) and consumers (“Consumer”, “you”) via www.claravioletvancouver.com. By using our website or services, you agree to these terms.


Article 1 – Definitions

  • Cancellation period: the period in which the consumer can exercise the right of withdrawal.

  • Consumer: a natural person acting outside the scope of a profession or business, who enters into a distance contract.

  • Day: calendar day.

  • Fixed-term contract: a distance contract for a series of products and/or services whose delivery or purchase obligation is spread over time.

  • Durable medium: any medium that allows information addressed personally to the consumer to be stored so it can be consulted in the future and reproduced unchanged.

  • Right of withdrawal: the consumer’s ability to cancel the distance contract within the withdrawal period.

  • Entrepreneur: Shopium B.V., trading as Clara & Violet Vancouver, offering products and services via distance selling.

  • Distance contract: agreement concluded within a system organized by the entrepreneur for the sale of products and/or services using exclusively distance communication means.

  • Distance communication technique: means used to conclude an agreement without the consumer and the entrepreneur being physically present together.

  • General Terms & Conditions: these terms.

Article 3 – Applicability

These terms apply to all offers and distance contracts. They are made available before the conclusion of the contract. For electronic agreements, terms can be stored electronically.

Specific product or service terms may apply in addition. In case of conflict, the most favorable provision for the consumer applies.

Invalid provisions do not affect the remainder of the contract; they will be replaced with equivalent provisions as closely as possible.


Article 4 – The Offer

  • All offers are non-binding unless explicitly stated.

  • Offers provide an accurate description of products/services, including images.

  • Prices exclude import duties and taxes; additional costs are the consumer’s responsibility.

  • Contracts include information on price, shipping, payment, delivery, withdrawal rights, duration, and applicable codes of conduct.

  • Optional: available sizes, colors, and materials.


Article 5 – Formation of the Contract

  • The contract is concluded when the consumer accepts the offer.

  • Electronic acceptance is immediately acknowledged.

  • We ensure secure electronic transmission of data.

  • We may verify consumer’s ability to fulfill payment obligations and refuse orders if reasonable grounds exist.

  • Upon delivery, the consumer receives: contact details, withdrawal rights, warranties, and terms for long-term contracts.


Article 6 – Right of Withdrawal

  • Consumers may cancel products within 14 days without reason, starting the day after receipt.

  • Products must be handled with care; only use for assessment.

  • Returns must include all accessories and original packaging.

  • Notification of withdrawal must be in writing/email; returned within 14 days.


Article 7 – Costs in Case of Withdrawal

  • Return shipping costs are borne by the consumer.

  • Payments will be refunded within 14 days after receipt of the returned product or proof of return.


Article 8 – Exclusion of Withdrawal Rights

Withdrawal may be excluded for:

  • Customized or personalized products

  • Products that spoil or age quickly

  • Hygiene products with broken seals

  • Audio, video, or software with broken seals

  • Services for transport, accommodation, catering, or events on specific dates

  • Betting and lotteries

Restocking fee: 15% may apply on returns if appropriate. Damaged or used products may be refused.


Article 9 – Prices

  • Prices are valid for the stated period; VAT or tax changes excepted.

  • Prices may fluctuate due to market conditions; target prices are indicated.

  • Delivery outside the EU: import VAT and fees are the customer’s responsibility.

  • Typographical errors do not bind the entrepreneur.


Article 10 – Conformity and Warranty

  • Products/services comply with the agreement, offer specifications, and legal requirements.

  • Defects must be reported within 14 days; returns in original packaging.

  • Warranty follows the manufacturer; misuse or improper handling voids warranty.

  • Self-repairs or third-party repairs void warranty.


Article 11 – Delivery and Execution

  • Orders are handled with care.

  • Delivery within 30 days unless otherwise agreed.

  • In case of delay or non-availability, the consumer may cancel free of charge.

  • Risk of damage/loss lies with the entrepreneur until delivery.


Article 12 – Duration, Termination, and Renewal

  • Open-ended contracts can be terminated at any time with 1 month’s notice.

  • Fixed-term contracts end automatically or per contract conditions.

  • Trial subscriptions end automatically at the trial period’s end.

  • Contracts longer than 1 year may be terminated after 1 year with 1 month’s notice.


Article 13 – Payment

  • Payment is due within 7 working days unless otherwise agreed.

  • Consumers must notify inaccuracies in payment details.

  • Reasonable collection costs may be charged in case of non-payment.


Article 14 – Complaints

  • Complaints must be reported within 7 days of discovery.

  • Responses within 14 days; if longer, an acknowledgment with estimated resolution time will be sent.

  • Justified complaints: product replacement or repair at no cost.


Article 15 – Disputes

  • Dutch law applies.

  • Disputes may be submitted to the competent court in the Netherlands.
